A Conservator and/or Guardian is appointed through the Probate Court. The appointment is made as a result of a petition process when it is determined that a person is not able to manage their financial or personal decisions themselves. This gives the appointee full authority to act on their behalf. The primary reason to do this is to protect assets of individuals and/or to protect them from exploitation.
This type of appointment can be used when dementia or other effects of aging put the person at risk. The authority allows the Conservator/Guardian to act on behalf of the individual, so their bills can continue to be paid, their real estate protected and their revenue stream is not interrupted. A Conservator/Guardian authority ends at death.
