Power of Attorney for Finances

A financial power of attorney is designed to appointed someone to to handle your finances when you are unable to act yourself. This is done through legal, estate planning documents and can protect you during a vulnerable time. If you become incapacitated, the person you gave financial power of attorney to will act on your behalf to manage your properties and financial details.

When the responsibility of financial power of attorney is left within the family it can potentially create a conflict or burden on the named party. Trustee or Successor Trustee

A trustee is an individual who manages assets titled to a trust. They assume fiduciary responsibility for managing those assets as directed by the Trust document. This appointment can be made by naming a person/business in your estate planning documents or it can be made through the probate court. A trustee provides trust administration and distribution of assets to beneficiaries.

Many individuals who create trusts name themselves as trustees, because it allows them to have full control of the trust while they’re living. However, a successor trustee must also be named for when the owner of the trust is deceased or incapacitated and no longer able to act as Trustee. This allows the management of the trust’s assets to continue undisturbed.

Conservator/Guardian

A Conservator and/or Guardian is appointed through the Probate Court. The appointment is made as a result of a petition process when it is determined that a person is not able to manage their financial or personal decisions themselves. This gives the appointee full authority to act on their behalf. The primary reason to do this is to protect assets of individuals and/or to protect them from exploitation.

This type of appointment can be used when dementia or other effects of aging put the person at risk. The authority allows the conservator/guardian to act on behalf of the individual, so their bills can continue to be paid, their real estate protected and their revenue stream is not interrupted. A Conservator/Guardian authority ends at death.
